I was looking for a classic car. I ended up losing $7,500 dollars on a piece of junk that doesn't run, plus shipping costs, storage costs, time and expenses.

This car was found on-line, at autotrader.com and/or collectorcartraderonline.com. Mike Daulerio (and Frank Daulerio by association) advertised the car in colletorcartraderonline.com. Mike averages about twenty (20) to forty (40) cars a month on these sites. Both sites refused comment, nor do they have or will instate, at our request, a Dealer Rating System (similar to Ebay) to Protect Buyers on their respective sites. Beware to the consumer.

I called Mike right away when I received the car and voiced my complaints, I also sent him a gripe letter, explaining my position and requested a full refund. Mike claimed he could not afford to refund my money. I later found out that Mike purchased a vintage hotel in downtown Ambler, and boasts about restoring it to it's original elegance. This does not sound like a man who can't afford to refund my money.

Then I received a letter from his lawyer/attorney/friend (this made me think that this must happen often, especially if you have to get bullies involved). This letter was never read, I simply threw it away. I never received a check for my refund on the purchase. As a car salesman and/or dealer, Mike, in Pennsylvania and in many other states must warranty the car's drivability regardless of any verbal or posted warranty or expression of an "as is" warranty.

This wouldn't be so bad if I was the only one (victim). I have found other victim(s) of Executive Motor Cars. I found one such victim only two weeks after my purchase. Same story, engine runs, light restoration, just out of storage and again same results, blown engine, major restoration and rust, and non-operational. And yes they received a letter from Mike's lawyer/friend as well.

Going at this rate of average we have over 24 victims per year (this is just an estimate).

We have and will continue to track Mike's sales/business for as long as he advertises on-line and in autotrader publications.

Some Facts

1. I had to call the local Ambler Police Department to receive a title. The police officer told me that he thought Executive Motor Cars was a repair shop and never knew they sold cars.

2. The title did not arrive for three (3)months. Title was not clean, but owing taxes with Penn Dot instructions for nonresistant.

3. I never received a bill of sale, it's been over a year. This is from a man who has a talk-radio show on WPEN, called "Car Show" Mike claims to be a 30 year experienced car veteran, but veteran of what is more the question.

4. Car shows salvage number(s) on bumper.

5. Engine's blown, cylinders pumping oil, plugs clogged.

6. Exhaust fell off and crumbled.

7. No Brakes, unsafe, you need to pump the pedal to pressurize. Veteran car salesman, Mike Daulerio, recommend to that the third, non operating brake cylinder be simply removed and disconnected. You mean I am suppose to drive a round on three brakes Mike?

8. Transmission leaks oil and is blown.

9. Battery was new, but cable broke off.

10. Gas tanks were both rusted solid. Fuel was added to one tank for shipment, combined with two cup sediment. This is really sad.

11. More rust than expected, large 1' x 2' hole on drivers side floor, fingers through doors, chrome rotted and pitted.

12. DOT in Pennsylvania said could find no dealership information on Executive Motor Cars. And that Mike was in violation of Pennsylvania Civil Code 76. Pa. Code 53.9. (Section 12), by failing to transfer title the title to the lawfully entitled transferee.

13. Car history is currently being traced.

14. The State Attorney has also been notified and we are in contact.

15. We are in the process of notifying, FTC, Consumer Affairs, Better Business Bureau, Chamber of Commerce National and Local, and many more.

Mike, it might be easier for you to make refund my money plus damages, time, cost, and expenses. It's time to make good Mike.

I will soon post the questions I asked Mike Daulerio accompanied by some graphic pictures including the original ad placed in Auto Trader. I will provide notes I took when speaking to him about the purchase, and then some more notes from a call Mike placed after the car was purchased (that's when I knew something was amiss), pictures of the car, current damages, suggestion on how to buy a car on-line and a little federal law.

There's more to come.

Waiting For A Refund, esq.
